Conveyance of land by heirs of Luther C. Jeffress, deceased

DEED BOOK 34, PP 563-565 1882 CHILDREN OF LUTHER C. JEFFRESS . AND WIFE 
BETTIE H. JEFFRESS (OVERBY) This deed made and entered into this 26th day of 
December A. D. 188_, between W. Horace Jeffress, N. C. Wilson, Laura C. his 
wife, E. H. Jeffress, and Sallie B. his wife, John J. Hardy and Mattie E. 
his wife, and Herbert L. Overbey. Whereas Luther C. Jeffress departed this 
life seized and possessed of a valuable tract of land in the County of 
Prince Edward divided by the public road from Charlotte to Prince Edward Co 
. ...... and a tract in the county of Charlotte. .and left surviving him 
widow, Bettie H. afterwards Bettie H. Overbey and now deceased and the 
following children: W. Horace Jeffress, Laura C. who intermarried with N. C. 
Wilson, E. H. Jeffress, Mattie E. who intermarried with John J. Hardy and L. 
C. Jeffress as his heirs at law, And the said L. C. Jeffress Jr. departed 
this life ...... first made iiis last will and testament by ... 
he devised his one fifth interest in the said estate to his brothers and 
sisters of whole ..... And whereas, Bettie H. Overbey 
purchased the interest of E. H. Jeffress in his father's real estate before 
the death of L. C. Jefftess Jr. and whereas the said W. Horace JeMess has 
purchased from N. C. Wilson and Laura C. his wife their interest in the land 
which came to Laura C. from her mother Bettie H. Overby and her brother L. 
C. Jeffress, and has sold the same together with his 1/5 interest in the 
land of which his father died seized to his brother E. H. Jeffress. And 
whereas the same N. C. Wilson and Laura C. his wife have sold the interest 
which descended to the said Laura C. being 1/5 interest and to the land of 
which her father died seized to John J. Hardy. And whereas valuable 
consideration for said purchases had passed in each .... and no conveyance 
of the same has been made. And whereas it is now the design and purpose of 
the parties hereto to vest in the parties entitled thereto 
............... .interests in said lands and to divide...as herein after set 
forth and whereas H. L. Overby is incapable of attending to his interests 
and is under the age of twenty one years and .............. 
joining in the deed agrees to execute the same when he arrives of age, the 
division herein made being manifestly and largely to his advantage. Now, 
therefore, this deed witnesseth that for and in consideration of the 
premises and valuable consideration duly received the said N. C. Wilson and 
Laura C. his wife have bargained and sold and do by these presents convey 
with general warranty unto the said W. Horace Jeffress all of their 
undivided interest in and to the land inherited by Laura C. from her mother 
Bettie If. Overby and their brother L. C. Jeffress and the same trustees do 
part and convey with general warranty unto J. J. Hardy all the undivided 
interest in and to the lands inherited by Laura C. from her father L. C. 
Jeffress being 1/5 part and the said W. Horace Jeffress for and in 
consideration of the premises and for valuable consideration duly received 
has bargained and sold and doth by these presents convey with general 
warranty A of his undivided interest in and to the said several tracts of 
land whether inherited or purchased by him to E. H, Jeffress and the said E. 
H. Jeffress , Jno J. Hardy and Herbert L. Overby having 
......... to so divide the the said tract of land that E. H. Jeffress should 
have that portion of the Prince Edward tract lying east of the public road 
leading from Charlotte tL- Prince Edward County ............... 
and Jno. Hardy should have that portion of said tract lying west of said 
roads and that Herbert L. Overby should have the tract of land of about 
................ acres lying and being in the County of Charlotte. Now 
therefore this deed further witnesseth that for and in consideration of the 
release by and on the part of E. H. Jeffress and Sallie B. his wife of all 
their interest of every kind and description in and to the balance of the 
land in Prince Edward and the tract in kcharlotte the said John J. Hardy and 
Mattic E. his wife and Herbert L. Overbey do by these presents grant and 
convey unto the said E. H. Jeffress all of their right title and interest of 
every kind in and to the tract of land in the County of.Prince Edwards lying 
and being in the East side of the public road from Charlotte to Prince 
Edward Court House, And the said E. H. Jeffress and Sallie B. his wife and 
Herbert L. Overbey for and in consideration fo the release by and on the 
fpart of Jno. J. Hardy and Mattie E. his wife of all their interest of every 
W-$J kind and description in and to the balance of the land in Prince Edward 
and the tract in Charlotte do by these presents grant and convey unto the 
said Jn. J Hardy and Mattie E. his wife to be held by them according to 
their respective .... rights as set forth in the deeds. All the tracts of 
land in the county of Prince Edward heretofore mentioned and lying in the 
west side of the public road aforesaid and the said E. H. Jeffress and 
Sallie B. his wife and John J. Hardy and Mattie E. his wife fcjr and in 
consideration of the release by and on the tract of Herbert L. Overby to be 
reaffirmed when he arrives at the age of twenty one years, of all of his 
interest of every kind and description in and to the tract of land lying and 
being in the county of Pr. Ed. as aforesaid and hereinbefore conveyed to E. 
H. Jeffess and Jn. J. Hardy and Mattie E. his wife have bargained and sold 
and do by these presents convey unto the said Herbert L. Overby all their 
right title and interest in and to the tract of land lying and being in the 
county of Charlotte confining about .......... acres and separated 
from the Prince Edward land by a named strip of land owned by the Rev. T. C. 
Spencer. ~
