Know all men by these presents that we Thomas Tucker &
Gideon Tucker of the County of Hanover are held & firmly
bound unto John Adams and Wm. Rowe of the same
County In five hundred pds Currt. money To be paid to the sd. John
Adams & Wm. Rowe their certain attorney Exrs. or
administrators To which paymt. well & truly to be made we bind ourselves
Jointly & Severally our Joint & several Heirs Exrs. & Admrs.
firmly by these presents sealed with our seals & Dated this 1st day of
September 1789
Whereas There is an action now depending in the General Court between the
sd. Thomas & Gidn. Tucker Planfs. and the
sd. John Adams & Wm. Rowe Defts. Concerning
the right of the Land whereon John Adams now lives and part
of the Tract whereon Wm. Rowe now lives which the sd.
Thos. & Gidn. Tucker supposed that they had
a right to But are not Convinced that they ware mistaken and that they have
no just right to the sd. Land and doth agree to have the sd. suit dismist.
and In Consideration of the sd. John Adams & Wm.
Rowe paying their own Costs that they have expended in the sd. suit
they do Oblige themselves their heirs Exrs. &c never more to sett up
any right or Claim to the sd. Lands If Therefore the above bound
Thos. & Gidn. Tucker and their heirs shall
well & truly perfom the same then the above Obligation to be Void otherwise
to Remain in full force power & Virtue.
