In the name of God Amen I William Tucker of the County of Powhatan of sound perfect and disposing senses and memory do make ordain constitute and appoint this to be my last will and Testament in manner and form following First it is my desire that my Body be decently Interred in the plainest manner and as to what worldly Estate it hath pleased God to bestow on me I dispose of in manner and form following, after my Just debts are paid which I desire may be out of such Debts as may be due to me at the time of my decease together with the money (if any) in hand at such time. It is my desire that the Remainder of such money if any be equally divided between my sons Thomas Charles James or such of them as may be alive at my Death. I give to my Daughter Judith Five pounds and ____ thing else having already dow a good part by her. I give to the three Children of my son John Tucker Decd. by his last wife Twenty pounds each. I give to Sally Vaughan ten pounds. I do not charge my Daughter Mary with anything she may be thought indebted to me. I give to my son William ten acres of the land I live on to be laid off so as to injure the said Tract of Land as little as possible but to as included the Spring call'd the old School House Spring. I give to my son Jesse Tucker the remainder of my lands, that is all the Land I own after taken off the Ten acres already given my son William making my said son Jesse chargeable with the board of my Daughter Mary so long as she lives single and to give him my sd. Daughter Mary so long as she lives may to the use of the room she at Present occupies. The negro Man Slave by name Cull, I consider as my daughter Mary's property but should Jesse Hix who has a suit now depending against me for the said negro man Cull return him it is my desire that my Daughter Mary have as much so that part of my Estate which I shall hereafter direct to be sold as any one of my Children. But should my said daughter Mary keep the sd. negro Man Cull I give her my sd. Daughter Mary one feather bed & furniture and my riding horse _____ _____. It is my desire that the residue of my estate be sold and the money arising from the Sales after paying the Fifty five pounds already bequeathed Be divided between my sons Thomas, William, Charles, James & Jesse and my Daughter Elizabeth in the following manner that is to say to my son Jesse one tenth part, the Remainder equally between my sons Thomas, William, Charles & James and my Daughter Elizabeth. And lastly I do hereby appoint my sons William and James Executors of this my last will & testament hereby revoking all Wills by me heretofore made. In Witness whereof I have hereunto set my hand and affixed my seal this Thirtyeth day of September one thousand seven hundred & ninety. The erasures in the 60th and 13 lines of this will were made by me some time after the beginning this same & at the request of William Tucker, Sr. Signed by Jno. Swann.
At a Court of Quarter Sessions held for Powhatan County at Scottsville on Thursday the 17th day of March 1791. The last will and Testament of William Tucker decd. was presented in Court and proved by the oaths of the Witnesses thereto together with a Memorandum respecting an erasure in some part and was by the Court ordered to be recorded. And on the motion of William Tucker and James Tucker the Executors therein named who made Oaths thereto and together with John Swann Senior their Security entered and acknowledged their bond in the penalty of one Thousand pounds conditioned as the Law directs certificate is granted them for obtaining probat in due form.
